Mr. Dearing,
As you will recall, three
members of the CCCEOA board (Craig Meier, Tom Miller and myself) met with three
members of the Water Board (Ray Legendre, Bill Burkstaller and yourself) on
April 15th to discuss our thoughts, objections and concerns
regarding the proposed new well and tank.
During that meeting (and over the last two years) we outlined many
issues that were troubling to our homeowners.
Following is a recap of many of the thoughts and issues presented:
· The Tank – The location in the front of the subdivision is reason for concern regarding appearance, long-term maintenance, security, effect on property values, noise, lighting, catastrophic accident, etc. We already have some storage in the tower tank and since there is no legally mandated need, why not add a reasonably sized tank to supplement?
· The current infrastructure needs updating: A standby generator ought to be in place on the Riverwood well. In the interest of fire safety, the existing smaller lines and two-way hydrants ought to be scheduled for replacement. The site condition of the existing Country Club well needs to be improved and maintained.
· If we were able to reach an agreement, we would require a tightly worded document that insured that the appearance and maintenance would be guaranteed. Also, if the well did not produce the desired flow rate, then the property would be put back in its current condition and all rights and ownership would revert to CCCEOA.

At one point in the April 15th meeting, we were asked for our recommendations. We advised the tank should definitely be smaller than the originally proposed
608,000 gallons and smaller than the 292,000 gallon structure. Since the subdivisions are practically fully built out, and the tower tank has sufficed, we feel a tank of 125,000 to 150,000 gallons would be adequate. As cost is a major concern, the smaller tank would also be less expensive to erect and maintain. We offered to consider the possibility of re-sizing our lots from three to two to accommodate a lower profile tank and keep as much of the structure as possible in the existing wooded area. A long-term lease would also offer the Water Board an opportunity to conserve cash.
It was our understanding that the Water Board, as a result of our meeting that night, would take the following actions:
· Contact us to survey the area for alternative sites
· Consider a smaller tank
· Investigate a standby generator for Riverwood’s well site
· Determine existing well site ownership
· Consider lease versus buy possibilities
· Plan improvements to the Country Club well site
You can imagine our disbelief when reading your open letter to the homeowners. To imply that we have delayed or have been uncooperative is simply not factual. We have discussed these matters openly and in good faith, yet our attempts to negotiate an agreement have been consistently rebuffed. By the documentation we presented that night, it was obvious that we have thoroughly investigated all aspects of this matter and are confident in our positions. We respectfully ask that you follow through on the previously agreed above action list.
